Stage 1 - Deciding to Divorce
The spouse who seeks a divorce is known as the Petitioner.
The Petitioner seeks legal advice and/or obtains a petition form for divorce - including any statement of arrangements for children.
The Petitioner agrees the contents of the statements and petition, if possible, with other spouse. The spouse not petitioning for divorce is known as the Respondent.
In a number of cases agreeing the contents of the statements and petition may not be easy if a financial settlement cannot be reached between the parties or their legal advisers.
